Claimant’s Witness Statement
As will become obvious, I had no real idea how to write a witness statement; how it should be formatted, or what should be included in it. What I did know was that it had to be in numbered paragraphs with 1.5 line spacing and page numbers. I was also aware that any references it contained to documents in the hearing bundle, had to include the corresponding page number of the bundle. Since I had included so many appendices, I decided it would be sensible to make the first page a Contents page. I also had concerns about whether there was a limit to the length (number of pages) of witness statements. And I absent-mindedly submitted it, initially, without signing it.
This is my original witness statement, (the unsigned version), with formatting or spelling errors uncorrected.
Closing submission
On the penultimate day of the hearing, Mr Frew, for the Respondent, advised that in cases without a litigant in person, both legal teams would simultaneously submit their closing submissions electronically. The court would then have the opportunity to read them prior to the final session beginning. I had prepared myself for reading aloud a written statement (still to be completed) to the court on the final day, so this suggestion surprised me. I was advised by Judge Miller, that if I preferred I could still read aloud my statement (the choice was mine), but it would be more efficient if the closing submissions were submitted by 10am on the final day for the ET panel to read, and then the final session begin at 11am, which I agreed to. I worked on my submission that evening, including matters discussed during the hearing earlier that day, and checked it over the following morning before submitting it.
